TERMS AND CONDITIONS

The following Terms and Conditions (the "Terms", "Agreement") govern the use of the website [www.unworn.in] and the purchase of any products from Triaura Innovations Private Limited (hereinafter referred to as the "Company", "UNWORN", "We", "Us", or "Our").
By accessing our Platform or making a purchase, you ("Customer", "User", "Data Principal") agree to be bound by these Terms, including those additional terms and conditions and policies referenced herein and/or available by hyperlink.
1. LEGAL ENTITY AND JURISDICTION
1.1. The Platform is owned and operated by Triaura Innovations Private Limited, a company incorporated under the Companies Act, 2013, with its registered office at 5-1/16, Phase-3, Mythrinagar, Madinaguda, Hyderabad, Telangana - 500049. 1.2. These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.
2. THE "DROP" MODEL AND INVENTORY
2.1. Limited Nature: UNWORN operates on a "Drop" basis. All items are limited edition and once sold out, they may not be restocked. 2.2. No Reservation: Adding an item to your digital shopping cart does not constitute a reservation. Inventory is only secured upon the successful completion of the payment process and the issuance of an Order Confirmation email by our Shopify-hosted platform. 2.3. Overselling Protocols: In the event of a technical glitch resulting in "overselling" (where an order is accepted for an out-of-stock item), the Company reserves the right to cancel the order. In such cases, the Customer will be entitled to an immediate refund of the purchase price or, at the Company’s discretion, a discount code for a future collection. The Company is not liable for any disappointment or indirect damages resulting from inventory unavailability.
3. PRICING AND PAYMENT
3.1. Price Fluctuations: The Company reserves the right to modify the price of any product at any time without prior notice. Such changes will not affect orders for which a Confirmation Email has already been issued. 3.2. Razorpay Integration: All payments are processed via Razorpay. We do not store your financial credentials. 3.3. Payment Failures & Pending Status: In instances where funds are debited from a Customer’s account but the order is not confirmed on our Shopify dashboard ("Payment Pending"), the Company will hold the transaction for a reconciliation period (typically 24-48 hours). If the payment is eventually cleared by the bank, the order will be processed subject to inventory availability. If inventory is exhausted, a full refund will be initiated.
4. DOMESTIC SHIPPING AND RISK OF LOSS
4.1. Logistics Partner: All domestic shipments are managed via Shiprocket and its affiliated couriers. 4.2. Risk of Loss: The risk of loss and title for all products purchased from UNWORN pass to the Customer only once the package is marked as "Delivered" by the respective courier service. 4.3. Incorrect Address Liability: The Customer is solely responsible for providing accurate and complete shipping information. Triaura Innovations is not liable for deliveries to incorrect addresses provided by the Customer. If a package is returned to our warehouse due to an incorrect address, the Customer will be responsible for the additional shipping costs for re-delivery.
5. RETURNS, EXCHANGES, AND DEFECTS
5.1. No-Return Policy: Given the limited nature of our streetwear drops, all sales are final. We do not accept returns for "change of mind." 5.2. Size Exchanges: We accept exchanges for different sizes of the same design, provided the desired size is in stock. The item must be in its original "UNWORN" condition, unwashed, and with all tags intact. The Customer is responsible for all shipping costs associated with an exchange. 5.3. Manufacturing Defects: We take pride in our 240 GSM French Terry and puff print quality. If you receive a defective item, you must report the defect to support@unworn.in within 48 hours of the delivery timestamp. Reports made after this window will not be eligible for review. 5.4. Puff Print Variations: Customers acknowledge that puff printing is a specialized 3D process. Minor variations in texture or "height" are characteristic of the technique and do not constitute defects.
6. INTELLECTUAL PROPERTY RIGHTS
6.1. Ownership: All content on this Platform, including but not limited to the brand name "UNWORN - BEYOND THE HYPE," the "Beyond the Hype" graphics, lookbook photography, website code, and product designs, is the exclusive intellectual property of Triaura Innovations Private Limited. 6.2. Prohibited Usage: Customers and third parties are strictly prohibited from using our professional imagery, graphics, or branding for commercial gain. This includes using our lookbook photos to resell items on third-party marketplaces or second-hand apps. Unauthorized use will result in legal action and DMCA takedown notices.
7. USER-GENERATED CONTENT (UGC)
7.1. License Grant: If you post a photo or video wearing UNWORN apparel and tag our official handle @unworn-beyondthehype or use our brand-specific hashtags, you hereby grant Triaura Innovations Private Limited a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, and display that content on our website, social media channels, and marketing materials. 7.2. Attribution: We will endeavor to provide credit to the creator where possible, but failure to do so does not constitute a breach of this license.
8. LIMITATION OF LIABILITY
8.1. No Indirect Damages: To the maximum extent permitted by law, Triaura Innovations Private Limited shall not be liable for any indirect, incidental, special, or consequential damages. 8.2. Specific Exclusions: We are not liable for any losses arising from delayed deliveries (e.g., missed photoshoots, events, or gifting deadlines) or the improper care/washing of puff print garments. Our total liability for any claim shall not exceed the purchase price of the product in question.
9. TERMINATION OF USE
9.1. We reserve the right to terminate your access to the Platform or cancel your User Account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to the "UNWORN" brand reputation.
