The Company operates the streetwear brand UNWORN - BEYOND THE HYPE via the digital platform [www.unworn.in] (the "Platform"). We act as the "Data Fiduciary" as defined under the Digital Personal Data Protection Act, 2023.

This Policy applies to all "Data Principals" (users, customers, and visitors) who interact with our Platform. By accessing the Platform, creating a User Account, or purchasing "UNWORN" apparel, you provide your affirmative, specific, informed, and unambiguous consent to the processing of your personal data for the purposes outlined herein.

3. CATEGORIES OF PERSONAL DATA COLLECTED

To facilitate our "Drop" model and provide premium streetwear services, we collect the following:

  • A. Identity and Profile Data: Full name, username, password (encrypted), and gender.

  • B. Contact Data: Email address, telephone number, billing address, and shipping address.

  • C. Transactional Data: Details about payments to and from you and other details of products you have purchased from us.

  • D. Financial Data: We utilize Razorpay as our primary payment gateway. We do not store your full credit card or bank details on our servers. Financial data is collected and processed directly by Razorpay in a PCI-DSS compliant environment.

  • E. Technical Data: Internet Protocol (IP) address, login data, browser type and version, time zone setting, and operating system. This is collected via Shopify and Google Analytics 4 (GA4).

  • F. Marketing Data: Your preferences in receiving "Drop" notifications and marketing communications from us.

4. PURPOSES OF PROCESSING

We process your personal data under the legal basis of Performance of Contract and Consent. Specific purposes include:

  1. Account Management: To register you as a new customer and manage your User Account.

  2. Order Fulfillment: To process and deliver your orders, manage payments through Razorpay, and facilitate domestic logistics via our aggregator, Shiprocket.

  3. Customer Support: To notify you about changes to our terms or provide assistance via support@unworn.in.

  4. Marketing & Drop Notifications: To send you SMS or email alerts regarding new collection releases, provided you have opted-in.

  5. Platform Optimization: To use data analytics (GA4) to improve our Platform, products, and customer experience.

5. DATA SHARING AND RECIPIENTS

We do not sell your personal data. We share your data only with verified "Data Processors" necessary for our operations:

  • Platform Provider: Shopify Inc., which hosts our e-commerce infrastructure.

  • Payment Processor: Razorpay Software Private Limited, for secure transaction processing.

  • Logistics Aggregator: Bigfoot Retail Solutions Pvt. Ltd. (Shiprocket), to manage domestic shipping and courier assignments.

  • Analytics Provider: Google LLC (GA4), to monitor site traffic and performance.

  • Legal & Regulatory Authorities: When required by Indian law, including the Information Technology Act and tax regulations.

6. DATA LOCALIZATION AND TRANSFERS

As a Shopify-based merchant, your data may be stored on secure servers located outside of India (e.g., USA or Ireland). By using our Platform, you consent to this cross-border transfer. We ensure that our partners (Shopify, Google) maintain data protection standards equivalent to those required under Indian law.

7. DATA RETENTION POLICY

We retain your personal data only for as long as is necessary to fulfill the purposes for which it was collected:

  • Transaction Records: Retained for 7 years to comply with Indian tax and audit obligations.

  • User Accounts: Retained until you request account deletion.

  • Marketing Data: Retained until you withdraw consent via the "Unsubscribe" link.

8. COOKIES AND TRACKING

While you have indicated a "No Cookies" preference for specialized tracking, the Platform utilizes Essential Cookies required by Shopify for basic functionality (e.g., cart persistence and secure checkout). Analytics via GA4 are processed using anonymized identifiers to protect your privacy.

Our products are intended for individuals aged 18 and above. We do not knowingly collect data from minors. If we discover that a minor has provided us with personal data without parental consent, we will delete it immediately.
